Contract sum

The contract sum is the total fixed amount agreed upon which the principal shall pay to the contractor for the execution of the works.

The contract sum forms the financial cornerstone of a construction contract. It constitutes the amount payable to the contractor for the execution of the agreed works, including materials and any ancillary costs incorporated in the sum.

In practice, the contract sum governs the payment obligation, the settlement of additional and reduced work, and the basis for any indexation or price adjustments. In disputes concerning the scope of the works or liability for additional costs, the contract sum plays a central role in the assessment of the claim.

“The contractor has invoiced the contract sum in instalments as the work progressed.”
