Aanzegging
Notice
An aanzegging is the formal notification by the employer to the employee as to whether or not a fixed-term employment contract will be continued.
A notification requirement constitutes a statutory obligation under the Work and Security Act. The employer must inform the employee in writing, no later than one month before the expiry of a fixed-term contract, whether the contract will be renewed and, if so, on what terms.
This is relevant because failure to provide such notification, or providing it late, may give rise to a notification penalty equivalent to one month’s salary. The provision promotes legal certainty and prevents employees from remaining uncertain as to their position.
In practice, the notification is commonly sent by registered post or email and retained in the personnel file to avoid evidentiary difficulties.
“The employer sent the notice in a timely manner by email, so that the employee knew that the contract would not be renewed.”
