Administrative court

The administrative court is the specialized court that adjudicates disputes between citizens and public authorities in administrative law.

The administrative court hears appeals against decisions of administrative bodies, such as permits, subsidies, benefits and enforcement measures. It examines whether the decision has been taken lawfully and whether it complies with the requirements of administrative law.

In the Netherlands, the administrative court forms part of the administrative division of the district court, with appeals lying to the Administrative Jurisdiction Division of the Council of State or to specialised tribunals. The legal protection it affords is essential to safeguard citizens against improper government action.

In practice, a citizen must first lodge an objection with the administrative body before an appeal may be brought before the administrative court.

“The lawyer advised his client to lodge an appeal with the administrative court against the refusal of the environmental permit.”
