Appartementseigenaar

Apartment owner

An apartment owner is the person who holds ownership rights over an individual apartment in a building comprising multiple residential units.

An apartment owner holds the exclusive right of use over his own apartment and is a co-owner of the common parts of the building, such as the entrance hall, the roof and the elevator. This ownership is recorded in the deed of division and is subject to the provisions of statute and the rules of the association of owners (VvE).

The relevance of this concept lies in the obligations arising from membership of the VvE, including the payment of monthly contributions and compliance with the house rules. Disputes concerning maintenance, use or the allocation of costs arise regularly in practice.

In day-to-day practice, the apartment owner plays a central role in decision-making within the VvE and in transactions involving the sale or letting of the apartment.

“The apartment owner consented to the proposed renovation of the common lift.”
