Working Conditions Act
The Working Conditions Act, often referred to as the Arbowet, is the Dutch legislation that establishes rules for safe and healthy working conditions in the workplace.
The Working Conditions Act regulates the obligations of employers and employees to prevent occupational risks and to promote health and safety at work. The Act forms the basis for occupational health and safety policy and requires, among other things, the preparation of a risk inventory and evaluation (RI&E).
The Act is relevant because it may render employers liable in cases of insufficient protection of employees and imposes fines for violations. Employees have rights to information, instruction and a safe workplace.
In practice, compliance is monitored by the Inspectorate for Social Affairs and Employment, and the Act plays a role in occupational accidents, insurance matters and proceedings concerning employer liability.
“Pursuant to the Working Conditions Act, the employer must draw up an up-to-date risk inventory and evaluation and inform the employees about it.”
