Bedrijfshuuradviescommissie
Advisory Committee on Business Leases
The Business Premises Rent Advisory Committee is an independent committee that advises parties on the reasonableness of the rent for business premises.
The Business Premises Rent Advisory Committee advises on the amount of rent for business premises within the meaning of Article 7:290 of the Dutch Civil Code. The committee is composed of experts in real estate and tenancy law and issues non-binding advice to tenants and landlords.
Such advice may serve as a basis for negotiations between the parties or as evidence in proceedings before the subdistrict court. Although the advice is not binding, it is frequently followed in practice on account of the expertise of its members.
In practice, the committee is primarily consulted in disputes regarding rent at the commencement of the lease or upon review following expiry of the contractual term.
“The landlord decided to follow the advice of the Bedrijfshuuradviescommissie on the reasonable rent in order to avoid proceedings.”
