Notice of Appeal

A notice of appeal is the formal document by which an interested party lodges an appeal against a decision of an administrative authority with the administrative court.

A notice of appeal is the written document submitted to lodge an appeal against a decision of an administrative authority. It sets out the grounds of appeal, the identity of the appellant and the relief sought. The notice of appeal initiates proceedings before the administrative court.

It is significant because it safeguards citizens’ and businesses’ legal protection against decisions of public authorities. Without a timely and correctly lodged notice of appeal, a decision may become final and unappealable.

In practice, the notice of appeal is generally filed with the district court’s administrative law division, following completion of the objection procedure. The filing period is, in most cases, six weeks.

“The attorney filed a notice of appeal with the court on behalf of the client to challenge the municipality’s decision.”
