Protective administration

Protective administration is a court-ordered measure under which an administrator assumes financial management on behalf of an adult who is incapable of managing their own affairs.

Protective administration, as governed by Book 1 of the Dutch Civil Code, is a measure instituted by the cantonal court judge to protect the assets of the person concerned. The administrator manages the property, effects payments and enters into contracts on behalf of the person concerned, while the person concerned retains limited powers of disposal.

This form of administration applies to persons with a mental disorder, addiction, dementia or other circumstances impairing their financial self-reliance. It serves to prevent exploitation, mismanagement and the accumulation of debts.

In practice, protective administration is frequently applied for by family members or care providers and is often combined with mentorship. The administrator renders annual accounts and reports to the court.

“The subdistrict court judge has, at the request of the children, placed their mother’s assets under protective administration due to her advanced dementia.”
