Attachment Syllabus

The Beslagsyllabus is an official manual setting out the procedures and guidelines for the levying and execution of attachments by court bailiffs.

The Attachment Syllabus is a document published by the Royal Professional Organisation of Court Bailiffs (KBvG) and serves as the standard reference work for attachment practice in the Netherlands. It sets out, step by step, the correct procedure for levying attachment on movable property, immovable property and claims, with due regard to statutory requirements and formalities.

The syllabus is relevant because it promotes uniformity and legal certainty in enforcement proceedings. Failure to comply with the guidelines it contains may render an attachment invalid, giving rise to liability or claims for damages.

In practice, lawyers and bailiffs consult the Attachment Syllabus in complex matters, such as third-party attachment or attachment of shares, in order to avoid errors and protect the interests of both creditor and debtor.

“The court bailiff followed the instructions set out in the Beslagsyllabus precisely when levying attachment on the debtor’s bank account.”
