Administrative fine

An administrative fine is a monetary penalty imposed by an administrative body for a breach of statutory provisions, without the intervention of the criminal courts.

The administrative fine is an enforcement instrument in administrative law. An administrative authority, such as a municipality, ministry or supervisory body, may impose this fine directly on the offender. This renders enforcement faster and more efficient than through criminal proceedings.

The fine is relevant because it enables the government to sanction violations on a large scale and at lower procedural costs, for example in the areas of traffic, the environment, construction or consumer protection. The party concerned may lodge an objection and subsequently file an appeal with the administrative court.

In practice, the administrative fine is widely used for minor to moderately serious violations where there is no intent or recidivism.

“The Inspectorate for the Environment and Transport imposed an administrative fine for the carriage of dangerous goods without the required permit.”
