Administrative Decision

An administrative decision is a written decision of an administrative authority that produces legal effects for citizens or organisations.

In Dutch administrative law, as governed by the General Administrative Law Act (Awb), an administrative decision is defined as a written decision of an administrative authority that does not constitute a generally binding regulation or a policy rule. The decision must be intended to produce legal effects and may concern individual cases, such as the grant or refusal of a licence.

An administrative decision is significant because it constitutes the basis for lodging an objection or bringing an appeal. Citizens and undertakings may challenge such a decision before the administrative court where they consider themselves aggrieved.

In practice, the concept is frequently invoked in decisions of municipalities, provinces and ministries concerning matters such as subsidies, enforcement and licensing. It safeguards legal protection and ensures careful decision-making.

“The municipality adopted an administrative decision whereby the application for an environmental permit was refused.”
