Bevrijdende betaling
Discharging payment
A discharging payment is a payment that releases the debtor from his obligation to the creditor.
A discharging payment entails that the debtor, by making payment to the correct creditor or a third party duly authorised to receive it, is released from its obligation. This follows from the provisions of the Dutch Civil Code governing the performance of obligations, which require that payment satisfy the criteria of correctness and authority.
The significance of this concept lies in preventing double payment or liability; absent a discharging effect, the debtor remains obliged to pay. In practice, the issue arises particularly in payments to representatives, assignments and attachments, where the debtor must verify the recipient’s authority.
In legal practice, it is frequently necessary to determine whether a payment has a discharging effect, for instance in debt collection proceedings or disputes concerning the proper payee.
“By making the payment directly to the creditor, the debtor had effected a discharge of the debt, thereby extinguishing the claim.”
