Administration
Administration is a statutory measure whereby an administrator assumes management of the assets of an adult who is unable to do so themselves.
Administration is governed by Article 1:431 et seq. of the Civil Code and is intended to protect the assets of a vulnerable person against financial detriment. The subdistrict court judge may appoint an administrator where a person, by reason of a mental disorder, addiction or other circumstances, is incapable of managing their own property interests.
The administrator is responsible for managing assets such as bank accounts, real property and income, and must act in the interests of the person concerned. The person concerned retains, in principle, the power of disposition over their person, but not over the assets placed under administration.
In practice, administration is frequently applied for by family members or care professionals and may be combined with mentorship or curatorship. The measure may be ordered for a fixed term or for an indefinite period and is subject to periodic judicial review.
“The court has placed the client's assets under administration because, owing to an addiction, he was no longer capable of managing his financial affairs independently.”
