Objection
An objection is a formal written submission by an interested party challenging a decision of an administrative authority, for the purpose of requesting reconsideration.
An objection constitutes a procedural step in Dutch administrative law, enabling an interested party to challenge a decision issued by a public authority. This must ordinarily be effected within six weeks of publication by means of a notice of objection.
It is significant in that it forms the initial stage of administrative legal protection. It affords the administrative body the opportunity to reconsider its own decision prior to any recourse to the courts.
In practice, a hearing is frequently convened at which the objector may elaborate upon their position. The decision on the objection may result in the withdrawal, amendment or upholding of the original decision.
“The entrepreneur lodged an objection against the municipality's rejection of his subsidy application.”
