Bijzondere titel
Special Title
A particular title is a specific legal basis for the acquisition of a particular asset or right, for example by purchase or donation, as opposed to a universal title such as succession.
In Dutch patrimonial law, a distinction is made between acquisition by general title and by special title. A special title concerns the transfer of a specific object on the basis of a concrete legal relationship, whereby only that asset or right passes and not the transferor’s entire patrimony.
This distinction is relevant to the scope of the acquisition, the protection of third parties and the operation of the publicity regime. In practice, the transfer of immovable or movable property is almost invariably effected by special title, so that the acquirer does not assume liability for the transferor’s other debts.
“The buyer acquired the property by virtue of a special title, namely the purchase agreement concluded with the seller.”
