Algemene titel

General Title

The general title constitutes the introductory section of a statute or book within the Civil Code and contains general provisions applicable to the subsequent specific titles.

In Dutch law, and in particular in the Civil Code, the general title constitutes the first part of a book, setting out fundamental rules, definitions and principles. These provisions apply to all subsequent titles within that book and ensure uniform interpretation and application of the law.

The general title is relevant as it provides the basis for interpreting more specific statutory provisions and is frequently invoked in disputes regarding the scope or applicability of rules. In practice, attorneys and judges consult this title to ascertain whether a rule has universal application within a given field of law, such as property law or the law of obligations.

By centering the general title, the coherence of the legal system is maintained, and the application of specific titles in a manner inconsistent with the general principles is prevented.

“The lawyer referred in his submissions to the general title of Book 3 of the Dutch Civil Code in order to support the applicability of the ownership provisions.”
