Blokkeringsregeling
Blocking arrangement
The blocking arrangement is a statutory provision by which access to certain data or documents may be blocked in legal proceedings.
The blocking arrangement enables a party, often on grounds of privacy or confidentiality, to request that certain information be withheld from the opposing party or the court. This arises particularly in relation to medical records, commercially sensitive data or communications subject to privilege.
The arrangement is relevant because it protects the interests of the party concerned against unnecessary or harmful disclosure, while preserving the right to a fair trial. The court determines whether the blocking is justified.
In practice, the arrangement is frequently invoked in civil and administrative proceedings in which the production of documents is sought.
“The attorney invoked the blocking arrangement to shield his client's medical records from the opposing party.”
