Division of the estate
An estate division is the legal distribution of a joint estate between the parties, for example in the event of divorce or death.
A division of the estate involves the separation of assets and liabilities belonging to a joint estate. This process arises upon the termination of a community of property, such as in the event of divorce or succession.
It serves to clarify ownership rights and financial obligations, while preventing undivided estates from giving rise to disputes or obstructing the settlement of affairs.
In practice, a division of the estate is frequently recorded in a notarial deed, thereby rendering the allocation binding and enforceable against all parties concerned.
“After the divorce, a division of the estate was drawn up to divide the dwelling and the savings accounts.”
