Concurrente vordering
Ordinary claim
A concurrent claim is a non-preferential, unsecured claim in bankruptcy that ranks for payment only after preferential claims and estate claims.
An ordinary claim is a claim by a creditor that is neither preferential nor secured by a pledge or mortgage in bankruptcy. Such claims share pro rata in the remaining assets of the estate after estate debts and preferential claims have been satisfied.
The ranking is relevant because ordinary creditors typically receive a lower distribution, or none at all. They are paid only after preferential creditors and therefore bear the greatest risk in insolvency.
In practice, the term is used during the verification of claims by the trustee to determine the order of distribution.
“The trustee admitted the supplier’s claim as an ordinary claim, with the result that the supplier could only expect a distribution after the preferential creditors.”
