Appeal
An appeal is the legal remedy by which a party may have a judgment of a lower court reviewed and revised by a higher court.
Appeal is a fundamental legal remedy in Dutch procedural law. It affords parties the opportunity to challenge a judgment or ruling of a lower court, such as the district court, before a higher instance, usually the court of appeal.
This legal remedy is important because it contributes to the quality and fairness of the administration of justice. It enables the higher court to correct any errors and provides for a second assessment of the case, in which both the facts and the law are reviewed afresh.
In practice, an appeal must be lodged within the statutory time limit, after which the case is heard anew. Lawyers routinely advise their clients on the prospects and risks before resorting to this remedy.
“The plaintiff decided to appeal because he disagreed with the court's dismissal of his claim.”
