Executie
Execution
Execution is the compulsory enforcement of a judicial decision or enforceable title by a bailiff, in which coercive measures are employed to give effect to the judgment.
Enforcement refers to the stage following a final and unappealable judgment or order, during which the creditor enforces its rights. The bailiff may levy attachment on assets, bank accounts or income in order to compel payment or other performance.
The procedure is strictly regulated by the Dutch Code of Civil Procedure and requires an enforceable title. Without a valid title, enforcement is unlawful, and the debtor may oppose it through enforcement proceedings.
In practice, enforcement is relevant in cases of non-payment, maintenance orders arising from divorce proceedings, or eviction judgments. A lawyer assesses in advance whether enforcement is viable and proportionate.
“After the judgment became final, the bailiff commenced enforcement by levying attachment on the judgment debtor’s bank account.”
