Kostenveroordeling

Order for costs

A costs order is a judicial decision whereby the losing party to proceedings is ordered to pay the legal costs of the successful party.

An order for costs is the court's decision in civil proceedings to require one party to reimburse the costs incurred by the opposing party. This includes, inter alia, court fees, attorneys' fees and other necessary expenses arising in the course of the proceedings.

This mechanism is relevant in that it shields the successful party from undue financial exposure while simultaneously discouraging the commencement of proceedings without sufficient cause. In the absence of such an order, access to justice would become prohibitively expensive for many litigants.

In practice, the quantum of an order for costs is frequently determined by reference to the applicable liquidation tariffs, which prescribe a fixed amount for each procedural step.

“The court ordered the defendant to pay the costs of the proceedings, thereby requiring the defendant to reimburse the plaintiff for the litigation costs incurred by the latter.”
