Kwalitatieve verplichting

Qualitative obligation

A qualitative obligation is a burden attached to immovable property that binds not only the current owner but also his successors in title under a special title.

A qualitative obligation arises where the owner of an immovable property undertakes towards another party to perform an obligation connected with that property. Upon registration in the public registers, the obligation acquires proprietary effect, rendering it binding on subsequent owners as well.

This mechanism is of particular relevance because it enables the parties to establish enduring arrangements regarding the use or maintenance of real property without the need for such arrangements to be renewed upon each transfer of title. It thereby precludes a succeeding owner from evading obligations previously agreed upon.

In practice, a qualitative obligation is commonly incorporated in contracts of sale or notarial deeds in order to secure, for example, restrictions on use, maintenance obligations or prohibitions on specified activities.

“The deed of purchase included a qualitative obligation prohibiting the new owner from dividing the property into apartments.”
