Lato sensu

In the broad sense

Lato sensu means 'in the broad sense' and refers to a broad interpretation of a legal concept or statutory provision.

The term lato sensu is used in legal practice to indicate that a concept, rule or contractual provision is to be interpreted broadly, so as to encompass related or indirect situations as well. This is in contrast to stricto sensu, which requires a strict and literal reading.

In Dutch case law and legal literature the term frequently appears in the interpretation of statutes and agreements. A broad construction may be necessary to give effect to the intention of the legislature or the parties and to avoid inequitable outcomes.

“The court held that the liability clause had to be construed lato sensu, such that consequential damages also fell within the scope of the indemnity.”
