Stricto sensu

In the strict sense

Stricto sensu is a Latin term meaning “in the strict sense” and referring to a literal, restrictive interpretation of a concept or statutory provision.

Stricto sensu is a legal expression of Latin origin which literally means “in the strict sense”. It is used to indicate that a term, rule or provision is to be construed solely in its narrowest and literal meaning, without any broader interpretation or application by analogy.

The term is of particular relevance in legal practice because it draws a clear distinction with “lato sensu”, which denotes a broad interpretation. Especially in criminal law and in connection with restrictive statutory provisions, a stricto sensu construction prevents the unintended expansion of a rule’s scope.

In Dutch case law and contractual practice, the term is frequently invoked to emphasise the precise boundaries of a concept, for example when interpreting criminal offences or exception clauses.

“The court interpreted the concept of 'public' stricto sensu, such that only places accessible to an indefinite number of persons fell within the definition.”
