Model Regulations

The model regulations constitute a standard set of rules intended to serve as a template for the articles of association of an owners’ association (VvE) upon the division of a building into apartment rights.

The model regulations set out provisions governing the use, management, maintenance and allocation of costs relating to the common parts of an apartment building. They are drawn up by the legislator or by industry bodies and constitute the legal foundation for the deed of division.

Their relevance lies in the uniform regulation of owners’ rights and obligations, thereby preventing disputes within the owners’ association. Notaries and lawyers adopt the model as their starting point and tailor it to the particular circumstances of the building.

In practice, reference is frequently made to the model regulations of 1992 or subsequent versions, according to the date of the division. Departures from the model are permissible, provided they are expressly recorded in the deed.

“The notary referred in the deed of division to the model regulations for the provisions concerning the use of the common garden.”
