A patent is an exclusive right granted by the government to an inventor in respect of a technical invention, thereby preventing others from using, manufacturing or selling it without authorization.

A patent, also referred to in the Netherlands as an octrooi, is an intellectual property right that confers on the holder the exclusive right to exploit an invention for a maximum period of twenty years. This right is granted by authorities such as the Netherlands Patent Office or the European Patent Office following an examination of novelty, inventive step and industrial applicability.

It serves an important purpose by fostering innovation through the protection of inventors and undertakings against unauthorised copying, thereby rendering investments in research and development commercially viable. In the absence of patent protection, competitors could readily imitate innovations, diminishing the incentive to innovate.

In practice, patents play a significant role in sectors such as technology, pharmaceuticals and manufacturing. Lawyers regularly advise clients on the filing, enforcement and licensing of patents, as well as on potential infringement proceedings before the courts.

“The technology company has filed a patent application for its new software algorithm in order to stay ahead of the competition.”
