Neighbouring right

Neighbouring rights concern the rights of performers, phonogram producers and broadcasting organisations that exist alongside copyright.

Neighboring rights, also known as related rights, protect the interests of individuals and organizations that contribute to the creation and dissemination of works without themselves being authors. They encompass the rights of performing artists, producers and broadcasters.

These rights are relevant because they complement copyright and provide balanced protection in the media and entertainment sector. They enable right holders to collect remuneration for the use of their performances.

In practice, neighboring rights are often administered through collective management organizations such as Sena or NORMA, which arrange licenses and remuneration in respect of public performances or broadcasts.

“The singer claimed remuneration on the basis of her neighbouring right for the broadcast of her performance.”
