Private deed
A private deed is a document drawn up and signed by the parties themselves in which a legal act is recorded, without the involvement of a notary.
A private deed is a written instrument drawn up and signed by the parties involved. Unlike an authentic deed, it lacks the formal safeguards and probative force conferred by a notary, but it is in principle admissible as evidence with freely assessable probative value in civil proceedings.
The private deed is relevant because it provides an accessible and cost-effective means of recording agreements. For certain legal acts, such as the transfer of registered property, however, an authentic deed is required by law. In practice, private deeds are widely used for contracts such as employment contracts, lease agreements and loan agreements.
“The parties have recorded the purchase agreement for the dwelling in a private deed.”
