Request for Dissolution

An application for dissolution is a request submitted to the subdistrict court judge seeking termination of an employment contract. It is filed when continuation of the employment relationship is no longer possible or desirable.

A petition for dissolution is a formal procedure by which an employer or employee applies to the subdistrict court for the termination of the employment contract. This route is commonly pursued in cases of a seriously disrupted employment relationship, underperformance or business-related reasons, and constitutes an alternative to termination by mutual consent or the grant of a dismissal permit by the UWV.

The procedure is significant because the subdistrict court examines whether reasonable grounds exist and whether redeployment within the undertaking is feasible. Where the petition is granted, the court may award transitional compensation, thereby producing clear legal consequences for both parties.

In practice, such petitions are frequently submitted in situations involving conflict or long-term incapacity for work, where expedition and legal certainty are of primary importance.

“The employer filed a petition for dissolution of the employment contract with the subdistrict court judge on the grounds of a seriously disrupted employment relationship.”
