Good tenant conduct
Good tenant conduct is the statutory obligation of the tenant to use and maintain the leased property in a careful and reasonable manner.
In Dutch tenancy law, in particular Article 7:213 of the Dutch Civil Code, the duty of good tenant conduct requires the tenant to make proper use of the premises, prevent nuisance and report defects in a timely manner. This concept protects both the landlord and neighbouring residents against misuse or neglect.
A breach of good tenant conduct may result in warnings, termination of the lease or an award of damages. In practice, the courts assess whether the tenant has behaved as a reasonably prudent tenant would have done.
The concept is particularly relevant in cases involving neighbour nuisance, unlawful subletting or failure to carry out minor maintenance.
“The landlord sought rescission of the lease agreement on the grounds of repeated breaches of the tenant’s duty of good conduct by causing noise nuisance.”
