Distance contract

A distance contract is a contract concluded without the parties being physically present together, for example via the internet or telephone.

A distance contract is an agreement concluded between a consumer and a trader without the simultaneous physical presence of the parties. Such contracts are typically entered into by means of distance communication, including websites, email or telephone sales.

Under Dutch law, in particular Book 6 of the Dutch Civil Code, specific rules apply to distance contracts for the protection of the consumer. The trader must provide clear information prior to the conclusion of the contract, and the consumer is entitled to a fourteen-day withdrawal period.

In practice, these rules are relevant to webshops and online service providers, which must comply with strict information and formal requirements to avoid fines or invalidity.

“The customer concluded a distance contract by ordering the product via the webshop without ever meeting the seller in person.”
