Deed of Division

A deed of division is a notarial deed by which a building is subdivided into separate apartments or units. This establishes an owners’ association responsible for the management of the common parts.

A deed of division is a notarial deed executed to divide an immovable property, such as an apartment building or residential complex, into multiple separate ownership rights. The deed precisely defines the boundaries of the individual units and the common parts, together with the articles of association of the owners’ association to be formed.

The deed of division is significant as it constitutes the legal foundation for co-ownership and permits the conveyance of individual apartments. In the absence of such a deed, a building cannot be subdivided and the owners remain bound by the original undivided ownership.

In practice, the deed is registered in the public registers of the Land Registry, rendering the division binding on third parties. Amendments to the deed of division generally require a resolution of the owners’ association and a further notarial deed.

“The notary has drawn up the deed of division to enable the owners to sell their apartments separately and to establish an association of owners.”
