Division Regulations

A division regulation is the regulation that forms part of the deed of division and contains the rules for the use, management and maintenance of a building that has been subdivided into apartment rights.

The division regulations, together with the deed of division, constitute the notarial instrument by which immovable property is subdivided into separate ownership titles. They contain the articles of association of the owners’ association (VvE) and govern, among other matters, the rights and obligations of the owners, the apportionment of common expenses and the use of private units and common parts.

The regulations are significant in that they establish the legal basis for cooperation between owners and serve to prevent or resolve disputes concerning maintenance, alterations and contributions. Without such regulations, the VvE would be unable to function effectively.

In practice, the division regulations are consulted upon the acquisition of an apartment, in connection with proposed alterations or in the event of disputes within the VvE.

“The new owner carefully read through the division regulations to ascertain which rules applied to the use of the communal garden.”
