Supporting claim

A supporting claim is a claim held by a creditor that supports the bankruptcy petition of another creditor.

A supporting claim is a claim used to bolster an application for a bankruptcy order. Under the Bankruptcy Act, any such application must be substantiated not only by the applicant's own claim but also by at least one additional claim held by a third party.

This requirement is designed to prevent bankruptcy from being declared lightly on the strength of a single, possibly contested claim. In practice, the existence of the supporting claim is often established summarily by the production of invoices or other documentary evidence, whereupon the court determines whether the debtor has ceased to pay its debts as they fall due.

“The attorney presented a supporting claim to bolster his client's petition for bankruptcy.”
