Association of Owners

An owners’ association (VvE) is a mandatory legal entity in which the owners of apartment rights in a building are united for the purpose of regulating the management and maintenance of the common parts.

Upon the division of a building into apartment rights, an owners’ association is established by operation of law. This legal entity is responsible for promoting the common interests of the owners and for managing the common parts, such as roofs, stairwells and installations.

The owners’ association is relevant because it is responsible for collecting contributions, carrying out maintenance and adopting decisions that are binding on all owners. Without a properly functioning owners’ association, owners may encounter difficulties with the allocation of costs and disputes regarding responsibilities.

In practice, the owners’ association is governed by a board elected from among its members, and important decisions are taken at the annual owners’ meeting, within the framework set by the deed of division and the Civil Code.

“The owners decided during the meeting of the owners’ association to replace the elevator installation and to apportion the costs through the service charges.”
