Contract for Works

A contract for work is an agreement whereby the contractor undertakes towards the principal to complete a work of a material nature in return for payment of a price.

A contract for work is a special contract governed by Book 7 of the Dutch Civil Code. The contractor undertakes to perform the work and supply the materials necessary to achieve a specified result, such as the construction or renovation of a building.

This contract is relevant because it clearly defines the rights and obligations of the parties, including completion and handover, liability for defects, and payment of the contract sum. Without a clear agreement, disputes concerning quality, delays or additional costs may escalate rapidly.

In practice, contracts for work are frequently used in construction projects, where standard terms such as the UAV or UAV-GC are often incorporated by reference to regulate performance and the allocation of risks.

“The employer and the contractor have entered into a contract for the execution of works for the renovation of the office building.”
