Mediation Agreement
A mediation agreement is a contract between the parties and a mediator that sets out the terms of the mediation process for resolving a dispute.
A mediation agreement is a written contract by which the parties engage a neutral mediator to resolve their dispute without recourse to the courts. It governs, among other matters, the mediator’s role, the confidentiality of the discussions and the allocation of costs.
The agreement is significant in that it formalises the mediation process and binds the parties to the arrangements they have made, thereby facilitating an efficient and confidential resolution of disputes.
In practice, a mediation agreement is frequently concluded before the mediation commences and may also serve as the foundation for a subsequent settlement agreement if the parties reach an accord.
“The parties entered into a mediation agreement to resolve their dispute concerning the delivery terms through mediation.”
