Bodemprocedure
Proceedings on the merits
An action on the merits is the full proceedings in which the court renders a final judgment on the substance of the dispute, as opposed to summary proceedings.
The proceedings on the merits, also referred to as the principal action, constitute the ordinary judicial process for adjudicating a dispute. The parties exchange detailed pleadings, may adduce evidence and request an oral hearing, following which the court delivers a binding judgment.
This procedure is significant in that it produces a final determination of the legal relationship between the parties, carrying the force of res judicata. Summary proceedings, by contrast, afford only interim relief and generally require subsequent proceedings on the merits to achieve a conclusive outcome.
In practice, proceedings on the merits are frequently commenced after summary proceedings or are brought directly before the court in the absence of an urgent interest. While they take longer than summary proceedings, they afford greater legal certainty.
“The lawyer advised the client to commence proceedings on the merits after the summary proceedings in order to obtain a final judgment on contractual liability.”
