Collection
Debt collection is the process of recovering outstanding claims by a creditor or a collection agency. This is effected through amicable or judicial measures.
Debt collection refers to the recovery of debts that a debtor does not pay voluntarily. It typically commences with an amicable phase, during which the creditor issues reminders and may charge collection costs.
This process is relevant because it enables creditors to recover their claims and limit financial losses. In the Netherlands, debt collection is subject to strict rules, such as the Collection Costs Act, to prevent abuse.
In practice, businesses often engage a collection agency or lawyer when their own collection efforts are unsuccessful, after which proceedings may be brought before the subdistrict court.
“After sending multiple reminders, the company initiated collection proceedings to recover the unpaid invoice.”
