Rent Indexation
Rent indexation is the periodic adjustment of the rent on the basis of a predetermined index, such as the consumer price index or a specific rental index. This mechanism ensures that the rent increases in line with inflation.
Rent indexation refers to the contractual or statutory mechanism by which the rent payable for residential or commercial premises is adjusted annually by reference to an index figure. This index is frequently published by Statistics Netherlands and reflects inflation or movements in the rental market.
Indexation serves to enable landlords to preserve the real value of their rental income, while safeguarding tenants against arbitrary rent increases. The relevant provisions are set out in the Dutch Civil Code in the sections dealing with the lease of residential and commercial premises, and indexation is commonly incorporated as a standard clause in lease agreements.
In practice, indexation is applied on a fixed date, such as 1 July, and the calculation must be performed with precision to avoid disputes. Lawyers routinely review whether indexation has been applied correctly and whether it is consistent with mandatory statutory provisions.
“The rent indexation resulted this year in a 4.2% increase based on the applicable CPI index.”
