Rental price protection
Rent price protection is the statutory scheme that safeguards tenants of residential accommodation against excessive rents and unreasonable rent increases.
Rent price protection forms part of Dutch tenancy law and applies primarily to regulated residential accommodation. The protection is based on a points system under which the maximum rent is determined according to the quality and amenities of the dwelling.
The regulation is relevant because it safeguards tenants against exploitation by landlords and contributes to affordable housing. In the event of disputes over rent, a tenant may apply to the Rent Tribunal or the subdistrict court.
In practice, rent price protection is frequently invoked at the commencement of a new tenancy agreement or in respect of annual rent increases exceeding statutory limits.
“The tenant invoked the rent protection regime to challenge the proposed rent increase before the Rent Commission.”
