Costs of the proceedings
Costs of the proceedings are the costs incurred by the parties during legal proceedings, such as court fees and attorneys’ fees. The court may order the losing party to reimburse these costs to the prevailing party.
Costs of proceedings encompass all expenses arising in the course of judicial proceedings. These include court fees, attorneys’ fees, expert costs and any other necessary expenditures. In the Netherlands, the fundamental principle is that the losing party bears the costs of proceedings of the winning party.
The rules on costs of proceedings are significant because they may have financial consequences for both parties. The allocation of such costs can raise or lower the threshold for commencing proceedings and affects the ultimate resolution of a dispute.
In practice, the court determines in its judgment whether and to what extent costs of proceedings are recoverable. Fixed tariffs are often applied, although actual costs may also be awarded in certain cases.
“The court ordered the defendant to pay the plaintiff's full costs of the proceedings.”
