Jurisprudence

Jurisprudence refers to the body of judicial decisions that guide the interpretation and application of the law in the Netherlands.

Case law comprises all judgments and rulings delivered by Dutch courts in specific cases. Although the Netherlands does not adhere to a strict doctrine of precedent as in common law jurisdictions, earlier decisions play an important role in the interpretation of legislation.

Judges and lawyers consult case law to promote consistency and legal certainty. It assists in forecasting the outcome of proceedings and in substantiating positions in disputes.

In the practice of a law firm, case law is routinely relied upon to advise clients and to strengthen arguments in writs of summons or statements of defence.

“Counsel made extensive reference in his submissions to recent Supreme Court case law on liability.”
