Oplevering
Delivery
Completion is the moment at which the contractor hands over the completed works to the employer, at which point responsibility and risks pass.
In Dutch law, particularly in the context of contracts for work under Article 7:750 of the Dutch Civil Code, completion constitutes the formal handover of the works or performance. This moment marks the conclusion of execution and the commencement of any applicable warranty and limitation periods.
Completion is significant because, from that point forward, the client becomes obliged to pay the outstanding contract sum and the contractor ceases to be liable for normal wear and tear or subsequent damage. Any defects must be notified within a reasonable period after completion.
In practice, completion is frequently recorded in a completion protocol, which notes any visible defects. This document serves to prevent disputes regarding the condition of the works at the time of handover.
“Following handover of the new building, the client was able to make the remaining payment and take the building into occupation.”
