UWV Reassessment: Your Rights During Re-evaluation

Are you being reassessed by the UWV? Read about your rights during a disability re-evaluation, the procedure, and what to do if the outcome is unfavorable.

What Is a Reassessment by the UWV?

A reassessment is a re-evaluation of your incapacity for work by an insurance physician of the UWV (Employee Insurance Agency). The UWV may summon you for a reassessment if your situation may have changed, or if a previous assessment is due for review. This can have significant consequences for your benefits: your WIA benefit (WGA or IVA) can be reduced, terminated, or increased.

When Will You Be Reassessed?

The UWV schedules reassessments based on the expected development of your health. The insurance physician determines at the initial assessment when a reassessment is appropriate. This may be after one, two, or five years. You can also request a reassessment yourself if your health has deteriorated. Additionally, the UWV may initiate a reassessment following a legislative or policy change.

Your Rights During a Reassessment

During a reassessment, you have the right to:

  • View your medical file at the UWV in advance
  • Bring your own doctor or healthcare provider to the appointment
  • Submit medical information from your healthcare providers
  • File an objection against the outcome (within six weeks)
  • Request a second opinion from another insurance physician

Preparing for the Reassessment

Good preparation is essential. Collect up-to-date medical information from all your healthcare providers: general practitioner, specialist, psychologist, or physiotherapist. Describe concretely what you can and cannot do on an average day. The UWV assesses your functional capabilities, not just your diagnosis. Be honest but do not forget to clearly state your limitations.

Objection in Case of an Unfavourable Outcome

If the reassessment leads to a reduction or termination of your benefits, you can file an objection within six weeks. On objection, your case is reassessed by a different insurance physician (the objection insurance physician). If your objection is rejected, you can appeal to the court and subsequently to the Central Appeals Tribunal. Arslan Advocaten assists you in all stages of this process.

Frequently asked questions

Kan een herkeuring mijn uitkering verlagen?
Ja.
