Attachment
Attachment is a legal measure by which a debtor’s assets are seized in order to secure or collect a claim.
Attachment is an instrument of Dutch law by which a creditor may prevent a debtor from disposing of certain assets or claims. It takes two principal forms: conservatory attachment, which is levied to secure a claim before an enforceable title exists, and executory attachment, which follows a judgment or other enforceable title.
Its relevance lies in affording the creditor an effective means of obtaining recourse and preventing assets from being dissipated. Without attachment, the debtor could erode his estate, rendering subsequent enforcement futile.
In practice, attachment is frequently levied on bank accounts, real property or movable assets through a bailiff, after which the attached assets may no longer be freely transferred.
“The attorney had an attachment levied on the debtor’s residence to secure his client’s claim.”
