Statement of Defence

The statement of defence is the defendant's written response to the plaintiff's claim in civil proceedings.

The statement of defence is the first formal pleading submitted by the defendant following service of the summons. In it, the defendant contests the claim, raises preliminary objections and may advance a counterclaim.

This document is of considerable importance, as it records the defendant’s positions and enables the court to proceed with the matter. If the defendant fails to file a statement of defence, he risks judgment in default.

In practice, the statement of defence is ordinarily followed by a reply from the plaintiff and, where appropriate, a rejoinder, after which the case proceeds to an oral hearing.

“The defendant's counsel timely filed the statement of defence in order to contest the plaintiff's claim with reasons.”
