Final Judgment
A final judgment is the definitive ruling of a court of appeal that concludes a case on appeal.
A final judgment is the ruling by which a court of appeal definitively disposes of a civil or criminal case on appeal. It constitutes the conclusion of the appeal proceedings and thereby determines the rights and obligations of the parties at this level.
This judgment is relevant because it opens the possibility of lodging an appeal in cassation with the Supreme Court, whereas separate cassation appeals against interlocutory judgments or interim decisions are generally not available.
In practice, enforcement of the judgment often follows the final judgment, unless the losing party institutes cassation within the statutory time limit or applies for a provisional measure.
“The lawyer advised his client to lodge an appeal in cassation against the final judgment of the court of appeal within three months.”
