Graying attachment

Contesting an attachment is the process by which a third party challenges a levied attachment on the grounds of invalidity or uncertainty as to ownership.

Challenging an attachment refers to the situation in which a third party, typically a creditor or owner, contests an attachment already levied on the grounds that it is unlawful or insufficiently substantiated. This is ordinarily effected through summary proceedings or an opposition procedure before the court.

The term is employed in enforcement practice when the validity of the attachment is called into question, for instance because the attached assets do not belong to the debtor or because the attachment is disproportionate. Such a challenge may result in the attachment being lifted or limited.

In practice, challenging attachments is of particular relevance to counsel acting for third parties who incur loss as a result of attachment measures, such as attachments on bank accounts or movable property. It prevents unjustified attachments from remaining in force for extended periods and ensures prompt judicial review.

“The attorney filed an application to lift the attachment, on the ground that the vehicle was the property of the debtor’s spouse and not of the debtor.”
